Jauntr Terms of Use

Effective Operated by Serendip LLC Contact: info@jauntr.ai

Section 1

About these Terms

These Terms of Use (“Terms”) are an agreement between you and Serendip LLC (“Jauntr”, “we”, “our” or “us”). They cover your use of the Jauntr mobile apps for iOS and Android, the website at jauntr.ai, and all related features and services (together, the “Service”).

You will be asked to agree to these Terms when you create your Jauntr account. You must agree to them before you can use the Service or post any content. If you do not agree, please do not use the Service.

Our Privacy Policy explains how we collect, use and protect your personal information. It is available at https://www.jauntr.ai/privacy and forms part of these Terms.

Section 2

Who can use Jauntr

You must be at least 18 years old, or the age of majority where you live if that is higher, to use Jauntr.

Section 3

Your account

You can create an account using your email address. You agree to:

  • provide accurate information and keep it up to date;
  • keep your login details secure and not share your account with anyone else; and
  • tell us promptly at info@jauntr.ai if you think someone has accessed your account without permission.

You are responsible for activity that happens under your account.

Deleting your account. You can delete your account at any time by doing the following:

  • By email: if you can’t get into the app, email info@jauntr.ai from the email address linked to your account (or tell us your username) with the subject “Delete My Data”. We will confirm once your account is deleted.

As described in our Privacy Policy, your account, personal information and content (including jaunts, journal entries, photos, notes, ratings and friends) are permanently deleted within 30 days of your request. This cannot be undone. You will also lose access to any jaunts you have bought.

We keep limited records where we need to for legal, tax, payment or fraud-prevention reasons, such as records of purchases, sales and payouts. If you have sold jaunts, people who have already bought them keep their copies (see section 8). If you have earnings waiting, set up payouts before deleting your account so you don’t lose them.

Section 4

What Jauntr does

Jauntr helps you plan short trips. Using the Service, you can:

  • generate travel itineraries (“jaunts”) using artificial intelligence;
  • save, edit and organise your jaunts;
  • keep a travel journal with photos, notes and ratings;
  • keep jaunts private, share them with the people you travel with or publish them for anyone to discover, and share your journal with your friends; and
  • where available, publish, browse, buy and sell jaunts created by other users.

We may add, change or remove features over time.

Jauntr is a planning tool, not a travel agent. We do not book flights, hotels, tours or other travel services, and we are not a party to any booking you make with a third party.

Section 5

AI-generated itineraries

Jauntr uses artificial intelligence, including services provided by third-party AI providers, to generate itineraries and suggestions. AI output can be incomplete, out of date or wrong. For example, a place may have closed, opening hours or prices may have changed, or travel times between stops may be unrealistic.

Please treat every itinerary as a starting point, not a guarantee. Before you travel, you are responsible for checking:

  • opening hours, prices, availability and booking requirements;
  • visa, passport, health and entry requirements;
  • local laws, safety conditions and travel advisories; and
  • accessibility, dietary and other needs that matter to you.

Costs and budgets shown in Jauntr are planning estimates only. Actual prices may differ. Nothing in the Service is professional travel, legal, medical, financial or safety advice.

Your permission before we use AI. To generate a jaunt, the details you enter (such as your destination, dates, how many are travelling and your preferences) are sent to our AI provider, OpenAI. Please do not enter sensitive personal information into AI features.

Section 6

Your content

“Your content” means anything you create, upload or post in Jauntr, including jaunts you edit or publish, journal entries, photos, notes, ratings, reviews and profile information.

Privacy settings. Private jaunts are visible only to you. Shared jaunts can be seen by the people you share them with. Your journal can be seen by your friends on Jauntr.

Your responsibilities. You confirm that you have the right to post your content, including any photos, and that it does not break these Terms or the law or infringe anyone else’s rights. Only post photos of other people if you have their permission.

Section 7

Community rules

Jauntr has zero tolerance for objectionable content and abusive users. You must accept these Terms before you can post content on Jauntr. You agree not to:

  • post content that is unlawful, harassing, hateful, threatening, sexually explicit, violent or discriminatory;
  • bully, stalk, impersonate or abuse any person;
  • post false or misleading reviews, or content designed to mislead other travellers;
  • post someone else’s personal information without their permission;
  • infringe anyone’s copyright, trademark or other rights;
  • send spam, advertising or scams, or use the Service for commercial purposes we have not approved;
  • use Jauntr to generate content that promotes illegal or dangerous activity;
  • scrape, copy or collect data from the Service using automated means, or use it to train AI models;
  • reverse engineer, disrupt or try to gain unauthorised access to the Service or its systems; or
  • help anyone else do any of these things.

How we keep Jauntr safe. We use a mix of automated filters and human review to find and remove objectionable content, including in published jaunts, journal entries and profiles.

Reporting. You can report a jaunt, journal entry, profile or AI-generated content in the app by tapping ••• and choosing Report. You can also email info@jauntr.ai. We review every report and act on objectionable content within 24 hours. This may include removing the content and suspending or permanently removing the user who posted it.

Blocking. You can block any user by going to their profile, tapping ••• and choosing Block. A blocked user can’t see your profile, jaunts or journal, or send you friend requests, and they are not told that you blocked them. You can unblock them at any time in Settings.

We may remove any content, or restrict or remove any account, that we reasonably believe breaks these Terms, puts others at risk or exposes Jauntr to legal liability.

Section 8

Buying and selling jaunts

This section applies when the marketplace is available to you.

8.1 Buying a jaunt

When you buy a jaunt, you receive a personal, non-transferable licence to view and use it for your own travel planning. You can edit your copy for your own trip, but you may not resell or republish it.

Bought jaunts are linked to your Jauntr account. If you delete your account, you lose access to them.

Jaunts are created by other users (“sellers”), not by Jauntr. We do not guarantee the accuracy or quality of any jaunt. The travel checks in section 5 apply to bought jaunts too.

Purchases made in the iOS or Android app are processed by Apple or Google. Refunds are handled under section 9.

8.2 Selling a jaunt

You may only sell jaunts you created yourself, or that you have the right to sell. Your listing must describe the jaunt accurately.

You can create and publish free jaunts at any time. To sell a jaunt, you must first set up payouts.

Payouts to sellers are made through our payment partner, Stripe. To set up payouts you must create a Stripe account and accept the Stripe Connected Account Agreement. Stripe will verify your identity and tax information. Payout availability, timing and supported countries depend on Stripe and may change.

Jauntr charges a platform fee on each sale. The fee that applies is shown to you before you publish a jaunt for sale. Stripe may also charge fees when sending your payout, as shown during payout setup.

You are responsible for any taxes that apply to your earnings, and for providing accurate tax and identity information when asked.

We may hold or reverse payouts in cases of suspected fraud, refunds, chargebacks or breaches of these Terms.

If you remove a jaunt from sale, buyers who have already bought it keep access to their copy.

Section 9

Payments and in-app purchases

Some features require payment, such as buying a paid jaunt. Prices are shown in your local currency in the app before you buy, and payment is charged to your Apple ID or Google Play account when you confirm the purchase. If we introduce subscriptions or other paid features in the future, we will update these Terms first.

9.1 Refunds

Jauntr does not offer refunds. All purchases of jaunts are final, except where applicable law gives you a right to a refund.

Jaunts are bought through the App Store or Google Play, and refund requests should go to them first:

  • iPhone: request a refund at reportaproblem.apple.com. Apple handles these requests and decides them under its own policies.
  • Android: request a refund through Google Play. If Google directs you to us, we will consider your request only where applicable law requires a refund.

If a purchase is refunded, the jaunt is removed from your account and the seller’s earnings from that sale are reversed.

If something is wrong with a jaunt you bought, email us at info@jauntr.ai and we’ll help.

Section 10

Third-party services and links

Jauntr includes or links to services run by other companies, such as maps, places data, AI providers, payment providers and websites for hotels, tours and restaurants. We do not control these services and are not responsible for their content, availability or practices. Your use of them is subject to their own terms and privacy policies.

Section 11

Our intellectual property

The Service, including the Jauntr name, logo, design, software and content we create, is owned by Serendip LLC or its licensors and is protected by law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Jauntr app on devices you own or control, for your personal, non-commercial use. We reserve all rights not expressly granted.

If you send us feedback or ideas, we may use them without any obligation to you.

Section 12

Suspension and termination

You can stop using Jauntr and delete your account at any time (see section 3). We may suspend or end your access to the Service, with or without notice, if you break these Terms, if required by law, or if your use creates a risk for other users or for Jauntr. Sections that by their nature should continue after termination (including sections 6, 11, 13, 14, 15 and 16) will continue to apply.

Section 13

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY ITINERARY, PRICE, RECOMMENDATION OR USER CONTENT IS ACCURATE, SAFE OR SUITABLE FOR YOU. TRAVEL INVOLVES RISKS, AND YOU ARE RESPONSIBLE FOR YOUR OWN TRAVEL DECISIONS.

Some places do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

Section 14

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERENDIP LLC AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, OR FOR ANY LOSS, INJURY OR EXPENSE ARISING FROM TRAVEL YOU UNDERTAKE OR BOOKINGS YOU MAKE WITH THIRD PARTIES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US$100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

Section 15

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Serendip LLC from claims, losses and costs (including reasonable legal fees) arising from your content, your breach of these Terms or your misuse of the Service.

Section 16

Governing law and disputes

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Oakland County, Michigan, unless applicable law gives you the right to bring a claim in your local courts. Please contact us first at info@jauntr.ai so we can try to resolve any issue informally.

If you live in a country whose consumer laws give you rights that cannot be changed by contract, these Terms do not take those rights away.

Section 17

Changes to these Terms

We may update these Terms from time to time. The latest version will always be available at https://www.jauntr.ai/terms. If we make material changes, we will let you know in the app or by email before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.

Section 18

General

  • These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • If we do not enforce a right, that is not a waiver of it.
  • You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition or sale of assets.

Section 19

Additional terms for the App Store and Google Play

19.1 Apple App Store

If you downloaded Jauntr from the Apple App Store, the following terms also apply:

  • Acknowledgement. These Terms are between you and Serendip LLC only, not with Apple Inc. (“Apple”). Serendip LLC, not Apple, is solely responsible for the Jauntr app and its content.
  • Scope of licence. Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with the purchaser through Family Sharing or volume purchasing.
  • Maintenance and support. Serendip LLC is solely responsible for providing maintenance and support for the app. Apple has no obligation to provide any maintenance or support services for the app.
  • Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are Serendip LLC’s responsibility, to the extent not disclaimed in these Terms.
  • Product claims. Serendip LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, Serendip LLC, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints or claims about the app should be sent to: Serendip LLC, 220 S Main St, Royal Oak, MI 48067 or info@jauntr.ai.
  • Third-party terms. You must comply with any applicable third-party terms (such as your mobile carrier’s terms) when using the app.
  • Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

19.2 Google Play

If you downloaded Jauntr from Google Play, your use of the app is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app or its content. If these Terms conflict with the Google Play Terms of Service in relation to your use of the app, the Google Play Terms of Service apply to the extent of the conflict.
